VoiceStudioPro (“VSP”) provides the VoiceStudioPro Web site including the VoiceStudioPro Home Page and other VoiceStudioPro content (collectively, the ” Site”) subject to your compliance with the terms and conditions below. PLEASE READ THIS BEFORE ACCESSING THE Site. BY ACCESSING THE Site, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT ACCESS OR USE THE Site.

Service: VoiceStudioPro.com (the service) is a service that offers users the ability to order professional voice over services for use on their phone systems. You understand and agree that the Service is provided on an AS IS and AS AVAILABLE basis. VoiceStudioPro.com disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Service. VoiceStudioPro.com also reserves the right to modify, suspend or discontinue the Service with or without notice at any time and without any liability to you.

Ability to Accept Terms of Use: You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use. In any case, you affirm that you are over the age of 13, as VoiceStudioPro.com is not intended for children under 13.

Use: The Service is made available to you for personal and business use. You are responsible for maintaining the confidentiality of your Service password and account, and are responsible for all activities that occur under your account. VoiceStudioPro.com reserves the right to refuse or terminate service to anyone at any time without notice for any reason. You agree that you are responsible for your own communications and for any consequences thereof. Your use of the Service is subject to your acceptance of and compliance with the Agreement and any other polices or guidelines set forth by VoiceStudioPro.com. You agree that you will use the Service in compliance with all applicable local, state, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence. You shall not, shall not agree to, and shall not authorize or encourage any third party to: (i) use the Service to upload, transmit or otherwise distribute any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, contains viruses, or is otherwise objectionable as reasonably determined by VoiceStudioPro.com;

(ii) upload, transmit or otherwise distribute content that infringes upon another party’s intellectual property rights or other proprietary, contractual or fiduciary rights or obligations; (iii) prevent others from using the Service; (iv) use the Service for any fraudulent or inappropriate purpose; or (v) act in any way that violates the Agreement, as may be revised from time to time. Violation of any of the foregoing may result in immediate termination of this Agreement, and may subject you to state and federal penalties and other legal consequences. VoiceStudioPro.com reserves the right, but shall have no obligation, to investigate your use of the Service in order to determine whether a violation of the Agreement has occurred or to comply with any applicable law, regulation, legal process or governmental request.

Submission of Content: VoiceStudioPro.com allows registered users to submit content, including but not limited to, script uploads. 5.1 With the exception of file uploads, when contributing content to VoiceStudioPro.com, a) you consent that you are the original creator of the content and have all legal, moral, and other rights that may be necessary to grant us with the license set forth in this Agreement; b) you agree to grant to us worldwide, royalty-free, perpetual, non-exclusive right and license (including any moral rights or other necessary rights) to use, display, reproduce, modify, adapt, publish, distribute, perform, promote, archive, translate, and to create derivative works and compilations, in whole or in part. Such license will apply with respect to any form, media, and technology known or later developed; c) you acknowledge and agree that we shall have the right (but not obligation), in our sole discretion, to refuse to publish or to remove or block access to any Content you provide at any time and for any reason, with or without notice. 5.2 For file uploads, you acknowledge you are either the creator and owner of the file(s) you are uploading and grant the same rights to us as in section 5.1, or you have confirmed that the file(s) you are uploading have explicit licenses that allow free redistribution.

Content of the Service: VoiceStudioPro.com takes no responsibility for third party content (including, without limitation, any viruses or other disabling features), nor does VoiceStudioPro.com have any obligation to monitor such third party content. VoiceStudioPro.com reserves the right at all times to remove or refuse to distribute any content on the Service, such as content which violates the terms of this Agreement. VoiceStudioPro.com also reserves the right to access, read, preserve, and disclose any information as it reasonably believes is necessary to (a) satisfy any applicable law, regulation, legal process or governmental request, (b) enforce this Agreement, including investigation of potential violations hereof, (c) detect, prevent, or otherwise address fraud, security or technical issues (including, without limitation, the filtering of spam), (d) respond to user support requests, or (e) protect the rights, property or safety of VoiceStudioPro.com, its users and the public. VoiceStudioPro.com will not be responsible or liable for the exercise or non-exercise of its rights under this Agreement.

Ads: As a condition to using the Service, you agree and understand that VoiceStudioPro.com may display ads and other information adjacent to and related to the content it services. These include, but are not limited to, sponsored ads, Google AdSense Ads, as well as ads from other ad providers.

Indemnification: You agree to hold harmless and indemnify VoiceStudioPro.com, and its subsidiaries, affiliates, officers, agents, and employees from and against any third party claim arising from or in any way related to your use of the Service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys’ fees, of every kind and nature. In such a case, VoiceStudioPro.com will provide you with written notice of such claim, suit or action.

You must contact the original author if you wish to use a file in a way that is prohibited by the file license. All other content on this website, including but not limited to graphic files, code, news, articles, tutorials, reviews and forum postings are property of the original authors. Rules
While visiting the Site, you may also not: post, transmit or otherwise distribute information constituting or encouraging conduct that would constitute a criminal offense or give rise to civil liability, or otherwise use the Site in a manner which is contrary to law or would serve to restrict or inhibit any other user from using or enjoying the Site or the Internet; post or transmit any information or software which contains a virus, cancelbot, trojan horse, worm or other harmful or disruptive component; upload, post, publish, transmit, reproduce, or distribute in any way, information, software or other material obtained through the Site which is protected by copyright, or other intellectual property right, or derivative works with respect hereto, without obtaining permission of the copyright owner or rights holder.

Monitoring
VoiceStudio Pro has no obligation to monitor the Site. However, you agree that VoiceStudio Pro has the right to monitor the Site electronically from time to time and to disclose any information as necessary to satisfy any law, regulation or other governmental request, to operate the Site properly, or to protect itself or its subscribers. VoiceStudio Pro will not intentionally monitor or disclose any private electronic-mail message unless required by law. VoiceStudio Pro reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of this Agreement.

Privacy
VoiceStudio Pro cannot ensure or guarantee privacy for VoiceStudio Pro users. It is therefore recommended that this service not be used for the transmission of confidential information. Any such use shall be at the sole risk of the user, and VoiceStudio Pro and its affiliate and related companies shall be relieved of all liability in connection therewith.

Confidential Information
You authorize VoiceStudio Pro to collect from any party and to retain all relevant information relating to your use of the Site, and you hereby authorize any party to provide us with such information. You understand and agree that unless you notify VoiceStudio Pro to the contrary by e-mailing us, you further authorize VoiceStudio Pro to disclose, on a confidential basis, to any party with whom VoiceStudio Pro has business relations all relevant information relating to your dealings with us and the Site.

Indemnity
You agree to defend, indemnify and hold VoiceStudio Pro and its affiliate and related companies harmless from any and all liabilities, costs and expenses, including reasonable attorneys’ fees, related to any Violation of this Agreement by you or users of your account, or in connection with the use of the Site or the Internet or the placement or transmission of any message, information, software or other materials on the Site or on the Internet by you or users of your account.

Trademarks
VoiceStudio Pro™ and other names, logos and icons identifying VoiceStudio Pro and VoiceStudio Pro’ products and services referenced herein are trademarks or registered trademarks of VoiceStudio Pro. All other product and/or brand or company names mentioned herein are the trademarks of their respective owners.

Terms and Conditions
VoiceStudioPro (“VSP”) provides the VoiceStudioPro Web site including the VoiceStudioPro Home Page and other VoiceStudioPro content (collectively, the ” Site”) subject to your compliance with the terms and conditions below. PLEASE READ THIS BEFORE ACCESSING THE Site. BY ACCESSING THE Site, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT ACCESS OR USE THE Site.

If you are not 100% satisfied with your recordings, Voice Studio Pro will re-record your scripts at no cost to you up to two (2) additional times. Should you still not be satisfied with your recordings, and do not wish to choose an alternate Voice Talent, we will refund you 100% of your purchase amount.

To request a refund, simply reply to your order confirmation with such a request, or, you may contact us at 1-888-9-STUDIO or by email to [email protected] of all purchased recordings is done electronically. Final recordings will be delivered within 72-hours of order confirmation via e-mail or via your personalized client login. Please note that there may be additional delay should there be any pronunciations be required and/or script changes needed. Any such changes shall be communicated with clients as needed.

Scope
This Privacy Policy describes how we handle your personal information for our services on the VoiceStudioPro.com website. It applies generally to the VoiceStudioPro.com website and other related websites where this policy appears in the footer of the page (“the Sites”). Some Voice Studio Pro-branded websites, Voice Studio Pro-sponsored, or websites we operate may be governed by separate privacy policies. The policy that applies on any of our domains or subdomains is always the policy that appears in the footer of each website.

Our parent companies, sibling companies, subsidiaries’ and joint ventures’ privacy practices are similar to those described in this Privacy Policy. Subject to the requirements of applicable law, we strive to provide a consistent set of privacy practices throughout the global Voice Studio Pro community. By accepting the Privacy Policy and the Terms of Service in registration, you expressly consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy. This Privacy Policy is effective upon acceptance for new users and is otherwise effective on September 1st, 2011.

Collection
You can browse the Sites without telling us who you are or revealing any personal information about yourself. Once you give us your personal information, you are not anonymous to us. If you choose to provide us with personal information, you consent to the transfer and storage of that information to our servers located in the United States.

We may collect and store the following personal information:

• email address, physical contact information,( for example in the ordering page we may collect your first and last name, your phone number, your email address, a password and your country) and (depending on the service used) sometimes financial information, such as credit card or bank account numbers;
• transactional information based on your activities on the Sites (such as posting information, auditioning, giving ratings, and content you generate or that relates to your account);
• information you provide to purchase or buy a service;
• community discussions, chats, correspondence through the Site, and correspondence sent to us;
• computer sign-on data, statistics on page views, traffic to and from the Site, and ad data;
• other information, including IP address and standard web log information, and
• supplemental information from third parties. (For example, if the information you provide cannot be verified, we may ask you to send us additional information (such as your business registration), or to answer additional questions online to help verify your information.)

We use a credit card processing company to bill you for goods and services. These companies do not retain, share, store or use personally identifiable information for any other purposes. We use Pivotal Payments to fulfill payments. We may share personally identifiable information with them (the information that we share is basically related to the credit card holder which is: credit card number, expiration date, name of the card holder, billing address, city, state or providence, zip or postal code and country), you can find their privacy policy at PivotalPayments.com.

Marketing
We don’t share, sell, or rent your personal information to third parties for their marketing purposes without your explicit consent. We may combine your information with information we collect from other companies (such as demographic data) to improve and personalize our services.

If you no longer wish to receive our communications, you may opt-out of receiving them by using the link included in each email communication or by contacting our Customer Service Department at 1 (888) 9-STUDIO.

Use
Our primary purpose in collecting personal information is to provide you with a safe, smooth, efficient, and customized experience to complete the transaction process. You agree that we may use your personal information to:

• provide the services and customer support you request;
• resolve disputes, collect fees, and troubleshoot problems;
• prevent potentially prohibited or illegal activities and enforce our Terms of Service;
• customize, measure, and improve our services and the Sites’ content and layout;
• tell you about targeted marketing, service updates, promotional offers based on your communication preferences, compare information for accuracy and verify it with third parties.

Our Disclosure of Your Information
We may disclose personal information to respond to legal requirements, enforce our policies, respond to claims that a listing or other content violates the rights of others, or protect anyone’s rights, property, or safety.

We may also share your personal information with:

• members of our corporate family to help detect and prevent potentially illegal acts and provide joint services; (Our corporate affiliates will market only to users who request these services.)
• service providers under contract who help with our business operations; (such as fraud investigations, bill collection, affiliates, and community programs)

Cookies/Web beacons
We use “cookies” (small files placed on your hard drive) on certain pages of the Site to help analyze our web page flow, customize our services, measure promotional effectiveness, and promote trust and safety. No spam, spyware or spoofing
We and our users do not tolerate spam. Make sure to set your Voice Studio Pro notification preferences so that we can communicate with you according to your preferences. You are not licensed to add other Voice Studio Pro users, even a user who has purchased a service from you, to your mail list (email or physical mail) without their express consent. To report Voice Studio Pro related spam or spoof emails to Voice Studio Pro, please forward the email to [email protected].

Account Protection
Your password is the key to your account. Use unique numbers, letters, and special characters and do not disclose your Voice Studio Pro password to anyone. If you do share your password or your personal information with others, remember that you are responsible for all actions taken in the name of your account. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately notify Voice Studio Pro and change your password.

Accessing, Reviewing and Changing Your Personal Information
You can see, review, correct and change most of your personal information by logging into your account at Voice Studio Pro. Generally, we will not manually modify your personal information because it is very difficult to verify your identity remotely. You must promptly update your personal information if it changes or is inaccurate. Once you make a public posting, you may not be able to change or remove it. Upon your request, we will close your account and remove your personal information from view as soon as reasonably possible, based on your account activity and in accordance with applicable law. We do retain personal information from closed accounts in order to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms of Service, and take other actions otherwise permitted by law.

Security
The security of your personal information is important to us. When you enter sensitive information (such as credit card number) on our order forms, we encrypt that information using secure socket layer technology (SSL/TLS).
